IRS Form W-7 · Individual Taxpayer Identification Number Guide
U.S. Federal Tax Compliance · Form W-7 Advisory

Apply for a U.S. ITIN (Individual Taxpayer Identification Number)

An ITIN (Individual Taxpayer Identification Number) is a nine-digit U.S. tax identification number issued by the Internal Revenue Service (IRS). It is intended for individuals who need to comply with U.S. federal tax requirements but are not eligible for a Social Security Number (SSN). An ITIN does not, by itself, authorize work in the United States or establish immigration status.

Quick Summary IRS Form W-7
  • • Standard IRS Time: About 7 weeks (9–11 weeks peak season or from overseas/India).
  • • Standalone ID Proof: Valid passport (or 2+ qualifying original/certified documents).
  • • India Applicants: Apply via an IRS-authorized CAA to avoid mailing your original passport to the U.S.
01 · Eligibility Criteria Federal Tax Purpose

When Can You Apply for an ITIN?

You can apply when you have a valid U.S. federal tax purpose, such as:

  • ✓ You need to file a U.S. federal tax return (Form 1040 or Form 1040-NR) but are not eligible for an SSN.
  • ✓ You are a nonresident alien who needs to report U.S. income or reconcile tax withholding.
  • ✓ You need an ITIN as a spouse or dependent in qualifying U.S. tax situations.
  • ✓ You qualify for a specific IRS exception to the tax-return filing requirement (such as U.S. LLC/business ownership, Amazon/Shopify/online business withholding, or tax-treaty claims).
When to apply: In most cases, you apply when filing your U.S. federal tax return. If you qualify for an exception, you may be able to apply at another time. Simply wanting a U.S. ITIN does not automatically qualify you.
02 · Processing Timeline IRS Estimates

How Long Does It Take to Get an ITIN?

The IRS provides the following general processing estimates and document return timelines:

Category Estimated Time Details
Normal processing About 7 weeks For the IRS to notify you of your application status.
Tax season or overseas (incl. India) 9–11 weeks Longer during peak season (Jan 15–Apr 30) or for applicants filing from abroad.
Original passport return Up to 60 days If original documents are mailed to the IRS, allow up to 60 days for return delivery.
IRS Decision Notices: Once approved, you receive Notice CP565 confirming your ITIN assignment. If the IRS needs more information, it sends Notice CP566; a rejection is communicated via Notice CP567.

*Note: These are IRS estimates, not guaranteed delivery dates. Incomplete applications, additional document requests, and international shipping can add time.

03 · Submission Channels

Choose Your Application Method (India & Overseas Options)

Official IRS Acceptance Agent Program ↗
Option A · Recommended Often the Most Convenient

Apply Through an IRS-Authorized Certifying Acceptance Agent (CAA)

A Certifying Acceptance Agent (CAA) can verify your eligible identity documents locally, return your physical passport immediately, help prepare Form W-7, and submit your application package to the IRS. You avoid mailing your original physical passport to the United States.

Option B · Direct Mail Austin, TX IRS Operation

Apply Directly by International Mail or In-Person TAC

Complete Form W-7 and mail it with your U.S. federal tax return and required identity documents to the IRS ITIN Operation in Austin, Texas (or visit an eligible IRS Taxpayer Assistance Center in the U.S.). This avoids agent fees but normally requires sending your original passport or a copy certified by the issuing government agency.

04 · Required Documentation

Documents You Need (5-Item Checklist)

  • 1. Completed & Signed IRS Form W-7 Select the first-time application (or renewal) option and the reason code (e.g., Reason b for a nonresident alien filing a U.S. federal tax return) that matches your tax situation.
  • 2. U.S. Federal Income Tax Return Usually Form 1040-NR for a nonresident alien, or Form 1040 for a U.S. tax resident, unless an IRS exception applies.
  • 3. Valid Passport (Standalone Proof) A valid passport is generally the only standalone document proving both identity and foreign status. Without a passport, at least two eligible documents (including one with a photo) are required.
  • 4. U.S. Income & Withholding Records Client payment statements, Forms W-2, 1042-S, or 1099, invoices, and records showing where services were physically performed.
  • 5. Additional Exception / Treaty Evidence Supporting documentation for any claimed deductions, India–U.S. tax treaty benefits, LLC/partnership agreements, or refund claims.
Strict Certification Rule: The IRS requires original documents, copies certified by the issuing government agency, or CAA authentication. Ordinary photocopies and notarized copies are not accepted.
05 · Execution Workflow

Step-by-Step ITIN Application Process

Step 01

Confirm That You Need an ITIN

Verify a valid U.S. federal tax purpose and confirm you are not eligible for an SSN. U.S.-source income alone does not automatically require an ITIN; it depends on income type and residency.

Step 02

Determine the Correct Tax Return

Prepare Form 1040-NR (nonresident alien) or Form 1040 (U.S. resident for tax purposes). Note that compensation for freelance services performed physically in India is generally sourced where performed.

Step 03

Complete IRS Form W-7

Enter your full legal name, foreign and mailing address, date and country of birth, and citizenship. Select first-time applicant (or renewal) and the exact W-7 reason code.

Step 04

Attach Return & Identity Proof

Attach Form W-7 to the front of your federal tax return and leave the SSN field blank. Include your passport/identity proof or exception-specific evidence.

Step 05

Submit the Complete Package

Submit through an IRS-authorized Certifying Acceptance Agent (CAA) or mail via tracked international courier to the IRS ITIN Operation in Austin, TX. (First-time ITINs cannot be submitted via a simple online form or e-filed in the year assigned.)

Step 06

Track & Receive IRS Notice CP565

Keep copies and dispatch proof. If your return deadline is approaching, submit a timely extension request when needed rather than waiting for the ITIN to arrive.

06 · Official IRS ITIN Address

Where to Mail Your Application

If applying directly by mail, send your signed Form W-7, tax return, and identity documents to the IRS ITIN-specific address below (not the standard tax return address):

Internal Revenue Service
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342
USA
07 · Deadlines & India Tax Notes

General Filing Deadlines & Key Caveats

Taxpayer Situation General Filing Deadline
Nonresident alien with no employee wages subject to U.S. withholding June 15, 2026
Nonresident alien with employee wages subject to U.S. withholding April 15, 2026
Return with a valid timely filing extension Commonly October 15, 2026

Key Note for India Freelancers & Consultants: Compensation for personal services is generally sourced where the work is physically performed. If all services were performed physically in India, confirm whether U.S. withholding (such as Form 1042-S or 1099), U.S. business activity, or an India–U.S. tax treaty claim creates a filing requirement before submitting Form W-7.
